Schmidt & Schmidt provides Extracts from the land register of Poland with translation and Apostille.
Data on real estate of Poland are contained in two main closely related systems: State Register of property rights to real estate and Cadastre.
The State register of property rights to real estate is under the jurisdiction of the Ministry of Justice, Cadastre – to the jurisdiction of the Ministry of Internal Affairs and Administration.
The State register of property rights to land records rights, and the Cadastre – displays actual information. Updated data exchange is established between both systems.
The action of a register’s official may be challenged only in court.
The Register contains:
- general data on the objects and its owner
- restrictions, encumbrances and property rights of third-parties
- information about mortgage
The land register in Poland is public. However, individuals may carry out search of information about a specific project only by a registration number. Remaining search types are available only to persons authorized by the state (employees of courts and prosecutor’s office, court bailiffs etc.).
Receipt of any official documents from land register of Poland is made only for a fee.
From the register one may obtain:
- extract
- copy of a record
- certificate of closure of the register on a specific object
The main document provided from the real estate registers of Poland is a certificate from the electronic archive. This document is provided in Polish and contains the main information about the property:
- excerpt number
- date
- name of the authority that provided the information
- basis for providing information
- record number
- date of registration
- state registrar
- grounds for the right to arise
- reasons for making the entry
- form of ownership
- number of parts
- information about the owner
- data about the object (general characteristics, cadastral number, address, purpose, area, additional information)

Extract in electronic form is informative document and cannot be used in court.

Extracts from real estate registers may be obtained either in electronic or paper form with apostille.
Extract from the Real Estate Registers of Poland may be used for:
- confirmation of title to real estate
- receipt of information about the real estate item
- debt collection
- analysis of prices for real estate in different regions of Poland
- other commercial and analytical purposes
* some data may be unavailable for certain items, or may be provided for a fee.
Receipt of documents in electronic form if necessary base information is available is normally carried out for one working day.
Extracts from the land register are provided subject to the laws of Poland and to the Law on personal data protection.
The requests shall be processed within one business day. Courier delivery of the apostilled extract shall be paid additionally according to the courier tariff rates.
Apostilled extracts from Poland
Poland joinedthe Hague Convention on simplified legalization of documents on November 19, 2004, since August 14, 2005 the Convention came into force.
Thus, documents issued in Poland are subject to legalization based on a simplified procedure - apostilling, after certified translation such documents acquire full legal force on the territory of all other Hague Convention Member States.
As a rule of thumb, apostillation of extracts takes about two weeks.
